1. Acceptance of These Terms
These Terms of Service form a legal agreement between you and Webwall Sites. By accessing the website, creating an account, generating a website, purchasing a plan or otherwise using our services, you confirm that you have read, understood and agreed to these Terms.
If you do not agree to these Terms, you must not use the Webwall Sites platform or related services.
2. Our Service
Webwall Sites provides a managed website creation service for businesses. Depending on the selected plan, the service may include:
- Access to professional website templates
- Website generation based on information supplied by the customer
- Website setup and launch assistance
- Hosting and SSL
- Domain connection assistance
- Content updates
- Technical maintenance and support
- Analytics or contact form functionality
Features, limits and included services may vary by plan and may be described on our website, checkout page or order confirmation.
3. Eligibility
You must be legally capable of entering into a binding contract in order to use paid Webwall Sites services.
If you use the service on behalf of a company or another organisation, you confirm that you have authority to bind that organisation to these Terms.
4. Your Account
You are responsible for providing accurate and complete registration, billing and business information.
You are also responsible for:
- Keeping your login details confidential
- Restricting unauthorised access to your account
- Promptly informing us of suspected unauthorised use
- Keeping your contact and billing information up to date
You are responsible for all activity carried out through your account unless caused directly by a security failure for which Webwall Sites is legally responsible.
5. Customer Content
You retain ownership of the text, images, logos, trademarks, contact details and other materials you provide to us.
By submitting content, you grant Webwall Sites a non-exclusive, worldwide licence to host, reproduce, adapt, display and process that content only as necessary to provide, maintain and support your website.
You confirm that:
- You own the content or have permission to use it
- The content does not infringe third-party rights
- The content is accurate and lawful
- The content does not contain malware or harmful code
You are solely responsible for the legality, accuracy and suitability of customer content.
6. Website Delivery
Where we advertise delivery within 24 hours, the period normally begins after we have received all required information, content and payment.
Delivery times are estimates and may be affected by missing customer information, domain or DNS delays, third-party service delays, unusually complex requirements or technical incidents outside our reasonable control.
Minor delays do not automatically entitle the customer to a refund where the service is still being provided within a reasonable period.
7. Fees and Payments
Setup fees, subscription fees and other charges are displayed before purchase and must be paid in advance unless otherwise agreed in writing.
Prices may be stated exclusive or inclusive of applicable taxes depending on the checkout display and customer location.
Payments may be processed by a third-party payment provider. You may also be subject to the provider's own terms and privacy policy.
If payment fails, is reversed or remains overdue, we may suspend access to the platform, website or related services until the outstanding amount is paid.
8. Subscriptions and Renewals
Monthly and annual plans renew automatically at the end of each billing period unless cancelled before the next renewal date.
By purchasing a recurring plan, you authorise us or our payment provider to charge the applicable renewal fee using your stored payment method.
Cancellation prevents future renewals but does not normally create a refund for a billing period that has already started, except where required by law.
We may change subscription prices by providing reasonable advance notice. The new price will apply from a future renewal date.
9. Domains and Domain Connection
Unless the checkout or order confirmation explicitly states otherwise, the purchase of a domain name is not included in the Webwall Sites service.
Domain connection means that we assist in connecting a domain owned or controlled by the customer to the website.
You are responsible for registering and renewing your domain, maintaining access to your registrar, paying domain fees and providing correct DNS access or records.
Webwall Sites is not responsible for domain expiry, registrar lockouts or DNS problems caused by the customer or a third-party registrar.
10. Content Updates and Support
Where content updates are included, they are intended for reasonable changes to the existing website, such as edits to text, images, contact details or similar content.
Full redesigns, new custom functionality, large-scale content migration, e-commerce development, custom integrations or extensive new pages may be treated as additional work and quoted separately.
Support response times may vary according to workload, complexity and the customer's plan.
11. Acceptable Use
You must not use Webwall Sites for unlawful, abusive or harmful purposes.
Prohibited use includes fraud, scams, phishing, impersonation, malware, spyware, spam, copyright or trademark infringement, illegal products or activities, attempts to disrupt the platform and unauthorised access to systems or data.
We may remove content or suspend services where we reasonably believe these Terms, applicable law or third-party rights have been violated.
12. Webwall Sites Intellectual Property
The Webwall Sites platform, software, templates, design system, graphics, code, branding, documentation and related materials are owned by or licensed to Webwall Sites.
Your subscription gives you a limited right to use the provided website while your service remains active. It does not transfer ownership of the platform, software or underlying template system.
You may not copy, resell, distribute, reverse engineer or create competing products from the platform or templates unless expressly permitted in writing.
13. Service Availability
We aim to provide reliable service, but we do not guarantee that the platform or hosted websites will always be uninterrupted, error-free or available.
Availability may be affected by maintenance, security updates, hosting incidents, internet outages, third-party services or circumstances beyond our reasonable control.
We may modify or discontinue features where reasonably necessary for security, performance, legal or operational reasons.
14. Suspension and Termination
You may cancel your subscription according to the cancellation options made available through your account or support.
We may suspend or terminate services where fees remain unpaid, you breach these Terms, your website creates a security or legal risk, we are required to act by law, or your use materially harms the platform or other users.
After termination, the website may be taken offline and customer access may be removed. You should maintain your own copies of important customer content.
15. Refunds
Setup fees may become non-refundable once work has started, because they cover onboarding, preparation, configuration and production work.
Subscription fees are normally non-refundable for billing periods that have already started, except where required by applicable consumer law or expressly stated in a written refund policy.
Approved refunds will normally be returned through the original payment method.
16. Disclaimers
Webwall Sites provides website creation and hosting services. We do not guarantee specific rankings, traffic, sales, enquiries, revenue or business results.
SEO-ready means that a website may include a technically suitable structure and basic optimisation features. It does not guarantee search engine rankings.
You remain responsible for your business content, legal notices, industry-specific compliance, marketing claims and obligations toward your own customers.
17. Limitation of Liability
To the maximum extent permitted by law, Webwall Sites will not be liable for indirect, incidental, special or consequential loss, including loss of profits, revenue, business, data, goodwill or opportunities.
Our total liability arising from the service will not exceed the amount paid by the customer to Webwall Sites during the 12 months immediately before the event giving rise to the claim, unless a higher amount is required by law.
Nothing in these Terms excludes liability that cannot lawfully be excluded or limited.
18. Indemnity
To the extent permitted by law, you agree to compensate Webwall Sites for reasonable losses, claims or expenses arising from customer content, unlawful use of the service or a material breach of these Terms.
19. Changes to These Terms
We may update these Terms to reflect changes in the service, pricing, legal requirements or business operations.
Material changes will be communicated through the website, account area or email where appropriate. Continued use after the effective date of revised Terms constitutes acceptance of those changes.
20. Governing Law and Disputes
These Terms are governed by the laws of Greece, without prejudice to any mandatory rights available to consumers under the law of their country of residence.
The parties should first attempt to resolve disputes in good faith through direct communication. Where a dispute cannot be resolved, it will be submitted to the competent courts, subject to mandatory consumer jurisdiction rules.
21. Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force to the greatest extent permitted by law.
